At FREEPODS, we want you to have confidence in your vaping experience, whichever Product you choose. This Warranty Policy (“Policy”) explains the warranty FREEPODS LTD (“FREEPODS”, “we”, “our” or “us”) provides on devices and accessories purchased through freepods.co.uk (the “Website”), whether as a one-off order or as part of a Subscription. This Policy should be read alongside our Terms and Conditions, our Subscription Services terms, and our Returns & Refunds Policy. This warranty is in addition to, and does not affect, your statutory rights as a consumer — see Clause 6.
1. What This Warranty Covers
1.1 Cover against faults: All new devices and accessories purchased from us come with a warranty against manufacturing faults. If a device or accessory stops working properly within the applicable warranty period set out in Clause 1.2, through no fault of your own, we will repair or replace it free of charge, in accordance with this Policy.
1.2 Warranty periods: The following warranty periods apply from the date of delivery:
- Devices: 6 months, including devices supplied in Starter Kits, Device Kits, or as part of a Subscription.
- Chargers: 12 months, including USB and portable chargers.
- Atomisers and cartomisers: 7 days.
- E-liquids: we are unable to offer a warranty on e-liquid Products, due to the nature of the product. This does not affect your statutory rights — see Clause 6.
1.3 Your statutory rights: This warranty is offered in addition to your legal rights as a consumer and does not replace or limit them in any way.
2. What This Warranty Does Not Cover
This warranty does not cover faults resulting from fair wear and tear or misuse of a Product, including but not limited to:
- negligence by you or a third party;
- use of the Product other than in accordance with the user instructions provided with it;
- unauthorised repairs or other modifications;
- improper charging of your device, including the use of chargers or charging adaptors not supplied or approved by us; and
- damage caused by liquid ingress, dropping, or other accidental damage occurring after delivery.
3. Making a Warranty Claim
3.1 Contact us: If you think there is an issue with your device or accessory, please contact our Customer Care team on 07344 295 958 or at info@freepods.co.uk.
3.2 Information we will need: You will be asked to describe the fault in detail and to provide your order number or proof of purchase and the product’s batch or serial number, so please have this information to hand.
3.3 Returning your device for inspection: We may ask you to return the faulty device or accessory to us so that our technical team can investigate. Where we ask you to do this, we will cover the cost of return postage, or refund a reasonable amount you have paid for it. Failure to return the device or accessory when requested may affect your claim.
4. Technical Inspection and Outcome
4.1 How we assess your claim: Our technical team will inspect the returned device or accessory to confirm whether the fault is covered by this warranty, or whether it results from one of the causes set out in Clause 2.
4.2 If your claim is confirmed: If the Product is diagnosed as faulty and covered by this warranty, we will repair or replace it free of charge, and aim to dispatch the repaired or replacement Product to you using our Next Day Delivery service (see our Delivery Information policy) at no extra cost.
4.3 If we cannot repair or replace your Product: Where we are unable to repair or replace your device or accessory, we will refund the amount you paid for it.
4.4 If your claim is not covered: If our inspection finds that the fault results from one of the causes set out in Clause 2, we will not provide a free repair, replacement or refund. We will explain our findings to you, and will return the device or accessory to you, or, where you ask us to, provide a quote for a chargeable repair.
5. Returning a Device or Accessory to Us
5.1 How to send it back: Once you have contacted us under Clause 3, we will confirm the address to return your device or accessory to and any other instructions you need to follow.
5.2 Proof of return: We recommend using a tracked delivery service and keeping proof of postage until your claim has been resolved.
6. Your Statutory Rights
This warranty does not affect your statutory rights as a consumer under the Consumer Rights Act 2015 if a Product is faulty, not as described, or unfit for purpose. Where a fault is reported within the cancellation or return periods described in our Returns & Refunds Policy, that Policy may also apply alongside this warranty.
7. Devices Supplied as Part of a Subscription
If your device was supplied as part of a Subscription, including any additional, replacement or bonus device provided under a promotional hardware offer, this Policy applies in addition to our Subscription Services terms, which may set out further conditions on additional or replacement devices provided as part of your Subscription.
