These Terms and Conditions (“Terms”) apply to your use of freepods.co.uk (the “Website”) and to any purchase you make from FREEPODS LTD (“FREEPODS”, “we”, “our” or “us”), whether as a one-off order or as part of a Subscription. These Terms, together with the documents referred to in them, form the entire agreement between you and us. Those documents include our Privacy Policy, our Cookie Notice, our Age Verification Policy, our Delivery Information policy, our Returns & Refunds Policy, our Warranty policy, our TPD Compliance statement, and, if you hold a Subscription, our Subscription Services terms. If there is a conflict between these Terms and one of those documents on a matter that document specifically covers, that document will apply.
1. Introduction
1.1 What these Terms cover: These Terms govern your use of the Website and any purchase of products (“Products”) that you make from us, whether through the Website or by phone.
1.2 Why you should read them: Please make sure you have read these Terms carefully, especially the limitations of our liability, before using the Website or placing an order. You should print a copy of these Terms or save them for future reference.
1.3 Acceptance of these Terms: By using the Website, or by placing an order for a Product, you agree to and accept these Terms. If you do not agree to these Terms, you must not use the Website or place an order.
1.4 Eligibility: To use the Website to purchase Products, or to create an account or Subscription, you must be aged 18 years or over and have a registered postal address in the UK. We carry out age verification checks in accordance with our Age Verification Policy, and we will not dispatch any order until these have been completed successfully.
1.5 We may amend these Terms: We may change, modify or revise these Terms at any time. Any changes will apply 7 days after the date we post the updated Terms on the Website. These Terms were most recently updated on 1st June 2026. It is your responsibility to check that you have read and agree with the latest version of these Terms.

3. Using Our Website
3.1 Personal use only: You agree to use the Website only for your own personal, non-commercial use.
3.2 Availability: We do not guarantee that the Website, or any content on it, will always be available or uninterrupted. We may suspend, withdraw, discontinue or change all or part of the Website without notice, and we will not be liable to you if the Website is unavailable at any time.
3.3 Your responsibilities: You are responsible for ensuring that you have the hardware and software needed to access the Website, and for using your own virus protection. You are also responsible for ensuring that anyone who accesses the Website through your internet connection is aware of, and complies with, these Terms.
3.4 Acceptable use: You agree that you will not:
- use the Website to infringe the privacy or other rights of any other person;
- use the Website in a way that encourages or facilitates any criminal or unlawful activity, or causes distress, harm or inconvenience to any other person;
- attack the Website via a denial-of-service attack or otherwise attempt to damage the Website, our systems, or those of third parties, or access or attempt to access any other user’s data (this would be a criminal offence under the Computer Misuse Act 1990, and we will report any such breach to the relevant authorities);
- do anything that brings, or might bring, the Website or FREEPODS into disrepute;
- data mine, screen-scrape, or use automated means to query the Website without our prior written consent;
- introduce viruses, trojans, worms or other technologically harmful material to the Website; or
- suggest you have a commercial relationship with us, or that we have endorsed any content you submit, where this is not the case.
3.5 No guarantee of security: We do not guarantee that the Website will be secure or free from bugs or viruses.
4. Age Restrictions
4.1 18 and over only: Our Products are age-restricted and the Website is intended for use by adults aged 18 and over. Full details of how we verify your age, both when you order and at the point of delivery, are set out in our Age Verification Policy.
5. Our Content and Intellectual Property
5.1 Ownership: All copyright and other intellectual property rights in the text, graphics, images, logos and other content available on the Website (“Content”) are owned by us or used with permission.
5.2 Limited licence for personal use: You may view and download Content for your own personal, non-commercial use. You must not copy, reproduce, modify, distribute, or incorporate any Content into another work, including your own website, without our prior written permission. Our status as the owner of the Content must always be acknowledged.
5.3 Linking to our Website: You may link to the home page of the Website, but you may not deep link to any other page, or frame the Website on another website, without our specific written permission.
5.4 Trademarks: Unless otherwise specified, all trademarks used on the Website are the property of FREEPODS.
5.5 Breach of this Clause: If you copy, download or otherwise use Content in breach of these Terms, your right to use the Website will cease immediately.
6. Our Products
6.1 Product descriptions: The Products are as described on the Website from time to time. Images and packaging shown on the Website are for illustrative purposes only, and slight variations may occur between the delivered Product or packaging and the images shown. Please check the Product description before placing your order.
6.2 Availability: All Products are subject to availability. If a Product you have ordered is not available, we will tell you as soon as possible and will not process that part of your order.
6.3 Regulatory compliance: All vaping products we sell are notified to, and published by, the Medicines and Healthcare products Regulatory Agency (MHRA) before we offer them for sale, and meet the requirements of the Tobacco and Related Products Regulations 2016. 7. Placing a One-Off Order
7.1 How to order: You may place an order for a Product through the online order process on the Website, or by phone. The Website will guide you through the steps to check and correct any errors before you submit your order. Your order represents an offer to us to purchase a Product, which is submitted when you click “Make Payment” (or equivalent) at the end of the order process.
7.2 How we accept your order: Our acceptance of your order takes place when we send you an email confirming that your order has been dispatched (or, for a Subscription, confirming that your Subscription is active), at which point a contract will come into existence between you and us.
7.3 If we cannot accept your order: If we are unable to accept your order, we will tell you and will not charge you for the relevant Product. This may be because a Product is out of stock, because of an unexpected limit on our resources, because we have identified an error in the price or description of a Product, or because we are unable to meet a delivery deadline you have specified.
7.4 If we have made a pricing or description error: If we discover an error in the price or description of a Product you have ordered, we will tell you and give you the option to continue at the correct price or description, or to cancel your order. If we do not hear from you within 7 days, we will treat your order as cancelled and confirm this to you in writing.
7.5 Order changes: Once you have placed an order, please contact our Customer Care team as soon as possible if you need to make a change. We cannot guarantee that a change can be made once an order has been submitted.
8. Subscriptions
8.1 Subscription Services terms apply: If you create a Subscription, the creation, billing, amendment, pausing and cancellation of your Subscription is governed by our Subscription Services terms, which apply in addition to these Terms. Where there is a conflict between these Terms and our Subscription Services terms in relation to a Subscription, our Subscription Services terms will apply.
9. Pricing and Payment
9.1 Prices: All prices on the Website are shown in pounds sterling (GBP) and include VAT, unless stated otherwise. The price of a Product is as published on the Website at the date we accept your order.
9.2 Price changes: We may change our prices at any time, but this will not affect any order we have already accepted. We reserve the right to adjust prices to reflect changes in applicable duties or taxes affecting vaping products, including the Vaping Products Duty due to take effect in October 2026.
9.3 VAT changes: If the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the Products in full before the change takes effect.
9.4 How to pay: You can pay using the payment methods shown to you at checkout. Our checkout is operated on our behalf by a payment service provider; your use of the payment facility is subject to that provider’s own terms, which will be made available to you at checkout. We do not store your full card details.
9.5 Authorising payment: By placing an order, you authorise us to charge your chosen payment method for the price of your order. We will request authorisation for payment at the time you place your order, and we may reject or cancel your order if we do not receive this, or if we reasonably believe payment will be refused.
9.6 VAT receipts: We do not routinely issue VAT receipts for orders placed through the Website, but please contact our Customer Care team if you require one for business purposes.
10. Delivery
10.1 Delivery Information policy applies: Full details of where we deliver, our delivery methods and costs, age verification at the point of delivery, and what happens if you are not available to receive your order, are set out in our Delivery Information policy, which forms part of these Terms.
11. Cancellation, Returns and Refunds
11.1 Returns & Refunds Policy applies: Your right to cancel an order, return a Product, and receive a refund — including the special rules that apply to vaping products once their packaging or hygiene seal has been opened — are set out in full in our Returns & Refunds Policy, which forms part of these Terms.
11.2 Faulty devices and accessories: If a device or accessory develops a fault, please also see our Warranty policy, which explains the warranty periods that apply and how to make a claim, in addition to your rights under our Returns & Refunds Policy.
11.3 Your statutory rights: Nothing in these Terms, or in our Returns & Refunds Policy or Warranty policy, affects your statutory rights under the Consumer Rights Act 2015 if a Product is faulty, not as described, or unfit for purpose.
12. Creating an Account
12.1 How to register: You may place an order by creating an account on the Website, or as a guest. It is at our sole discretion whether we accept an application to create an account.
12.2 Eligibility: You must be aged 18 years or over with a UK registered postal address to create an account, in line with Clause 1.4.
12.3 One account per person: Only one account may be created per individual.
12.4 Accuracy of information: You confirm that the information you provide when creating an account is true, accurate and complete, and you must tell us promptly if anything changes. We accept no responsibility for orders that are not received because of an incomplete or incorrect address.
12.5 Your password: You are responsible for keeping your password confidential and for any activity on your account resulting from a failure to do so. Please notify us immediately if you suspect any unauthorised use of your account.
12.6 Cancelling your account: You may cancel your account at any time by contacting us. We may also suspend or cancel your account at any time, including where we reasonably believe these Terms have been breached.
13. Vaping Regulations and Product Compliance
13.1 Regulatory framework: Our Products are subject to the Tobacco and Related Products Regulations 2016, the Tobacco and Vapes Act 2026, and other applicable law. See our TPD Compliance statement for details of the product standards we require and our approach to MHRA registration.
13.2 Age verification: Our approach to verifying that customers are aged 18 or over, both online and at the point of delivery, is set out in our Age Verification Policy.
14. Your Privacy and Our Use of Cookies
14.1 Privacy Policy: Any personal information you provide to us will only be used in accordance with these Terms and our Privacy Policy. Please make sure you have read our Privacy Policy before providing any personal information to us.
14.2 Cookies: We use cookies and similar technologies on the Website. Please see our Cookie Notice for details of the cookies we use, why we use them, and how you can manage your preferences.
15. Our Liability to You
15.1 Loss or damage we are responsible for: If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable.
15.2 Domestic and private use: We supply Products, and provide the Website, for domestic and private use only. If you use a Product, or the Website, for any commercial, business or re-sale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
15.3 Website content: The content on the Website is provided for general information only. Although we make reasonable efforts to keep it accurate and up to date, we do not guarantee that it is complete or error-free, and you should not rely on it as advice.
15.4 Technical issues and third-party links: We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material arising from your use of the Website or any website linked to it. The Website may link to third-party websites; we do not endorse and are not responsible for the content of those websites.
15.5 What we do not exclude: Nothing in these Terms limits or excludes our liability for fraud or fraudulent misrepresentation, for death or personal injury caused by our negligence, or for any other liability that cannot be limited or excluded by law, including your rights under the Consumer Rights Act 2015.
16. Events Beyond Our Control
16.1 Force majeure: We will not be liable for any failure or delay in performing our obligations under these Terms where this is caused by circumstances beyond our reasonable control, including (but not limited to) accident, fire, flood, acts of God, strikes or other industrial disputes, shortage of materials, or legislative or administrative interference.
17. Other Important Terms
17.1 Language: These Terms may be presented to you in more than one language. The English language version will prevail.
17.2 Severability: Each clause of these Terms operates separately. If a court or relevant authority decides that any clause is unlawful or unenforceable, the remaining clauses will continue in full force and effect.
17.3 Waiver: If we delay in enforcing these Terms, or fail to insist that you perform any of your obligations, this will not mean that we have waived our rights, and will not prevent us from taking steps against you at a later date.
17.4 Transferring rights: You may only transfer your rights or obligations under these Terms to another person if we agree in writing. We may transfer our rights and obligations under these Terms to another organisation; we will tell you in writing if this happens and it will not affect your rights under these Terms.
17.5 Nobody else has rights under these Terms: These Terms are between you and us. No other person may enforce any of these Terms.
17.6 Notices: We will send notices to the email address you have provided to us. Notices sent by email are deemed received 24 hours after sending; notices sent by first class post are deemed received on the next working day.
17.7 Governing law: These Terms are governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
17.8 Alternative dispute resolution: If you are unhappy with how we have handled a complaint, alternative dispute resolution (“ADR”) may be available through a certified ADR provider. We will confirm the details of our ADR provider, if applicable, on the Website or on request. Using ADR is optional; you remain free to bring legal proceedings instead.
